A 64-year-old woman was recently awarded $1.2 million in a transvaginal mesh case against Johnson & Johnson. The jury determined that the plaintiff had suffered damages because the vaginal-mesh implant the woman received was defectively designed and was responsible for causing the her injuries. hospital-hand-1100587-m.jpg

The claim against Johnson & Johnson was based on a product called the TVT-O mesh sling. While the jury found for the plaintiff that the device was defective, they rejected the plaintiff’s claims that Johnson & Johnson failed to provide adequate warning about health risks associated with the sling. No punitive damages were awarded.

Coloplast is one of more than 30 manufacturers of vaginal mesh responsible for putting millions of women at risk. Transvaginal mesh (TVM) is used to treat pelvic organ prolapse (POP) and stress urinary continence (SUI), and Bloomberg reports that one manufacturer indicated that more than a million women have had mesh implanted over the past 15 years. shaking-hands-1097209-m.jpg

Unfortunately, vaginal mesh can begin to erode in the body and can fail to work as required for women. The mesh can cause women to experience significant pain, including discomfort during sexual intercourse. Vaginal mesh may also not be effective in treating POP, as many women experience recurrent prolapse of pelvic organs. Because of the myriad problems identified with vaginal mesh, the Food and Drug Administration issued an order in 2012 requiring manufacturers of mesh products to conduct studies to identify the rates of complications. These studies should assess how likely it is that the mesh will cause organ damage and other serious health problems.

In 2011, Endo Pharmaceuticals bought American Medical Systems (AMS) for $2.9 billion. When Endo bought AMS, Endo become responsible for any potential legal liability associated with products that AMS had sold to consumers. Unfortunately, this turned out to be a big issue since American Medical Systems was one of the primary manufacturers of transvaginal mesh products. old-medical-books-122275-m.jpg

TVM products made by a variety of manufacturers have caused very serious problems for patients, including severe pain, erosion of the mesh and recurrent pelvic organ prolapse (one of the very conditions the mesh was designed to treat). Thousands of lawsuits have been filed, and Endo reportedly set aside an additional $316 million for its “product liability reserve” to deal with vaginal mesh lawsuits. Plaintiffs who were harmed by the AMS products should consult with an experienced Boston transvaginal mesh lawyer for information on whether they could potentially obtain settlement funds or other damages for injuries.

More than 40,000 plaintiffs who have filed transvaginal mesh claims are suffering serious complications associated with the use of surgical mesh products. Many of the plaintiffs who experienced these complications have already been forced to undergo revision surgeries and to have other expensive medical treatments performed to resolve complications from failed surgical mesh products. Unfortunately, many of these thousands of women have not yet been paid by the companies that produced the mesh. hospital-corridor-3-65901-m.jpg

When plaintiffs are injured by a product and undergo medical treatment as a result, their health insurers often pay for the bills. Then, when the plaintiff recovers compensation in a personal injury or product liability lawsuit, the health insurer is often entitled to be reimbursed for expenses and outlays. A Boston transvaginal mesh lawyer can help victims injured by TVM products to understand the impact of these healthcare liens on the outcome of their case, since the liens must be addressed. Recently, for example, the court presiding over a large multi-district TVM case in West Virginia has issued a pretrial order appointing a Lien Resolution Administrator.

Throughout the federal court system in the United States, there are currently more than 35,000 lawsuits pending related to complications associated with transvaginal mesh products. Transvaginal mesh, or TVM, was marketed as an alternative to traditional surgical procedures to treat pelvic organ prolapse (POP) or stress urinary incontinence (SUI). Unfortunately, thousands of women who had vaginal mesh surgically implanted began to experience erosion of the mesh, resulting in significant pain and serious complications, including perforation of the pelvic organs and recurrent POP. vitals-monitor-294066-m.jpg

Women who have experienced these side effects have filed lawsuits against vaginal mesh manufacturers seeking compensation for the tremendous losses they have faced. Those harmed by defective medical devices should be compensated for any medical costs that they incur to treat their injuries, such as surgical removal of the mesh. Individuals harmed by TVM products are also entitled to compensation for lost income, pain and suffering and emotional distress associated with injuries caused by the defective mesh products. Taking legal action to recover compensation for these losses is necessary, and the more than 35,000 lawsuits show that many women are exercising their legal rights.

When so many cases are filed by injured victims, Boston transvaginal mesh lawyers know that the formation of multi-district litigations is a common and effective way to resolve patient complaints. There are currently six MDLs pending and a group of plaintiffs is now calling for the creating of a seventh.
